These Terms of Service govern access to and use of hearthandhuehome.com. The website and store are operated by HEARTH & HUE LLC.

By using the website, you agree to these Terms. Mandatory consumer rights that apply to you are not excluded or restricted.

You must not:

Product Information

We aim to present product descriptions, colors, dimensions and images accurately.

Colors may appear differently depending on the customer’s screen and display settings. Minor variations may occur in products made from woven, mineral, cork, felt or other naturally variable materials.

These reasonable variations do not limit rights relating to goods that are defective, materially different from their description or otherwise non-conforming.

Orders

Submitting an order is an offer to purchase the selected products.

An automated order acknowledgement confirms receipt of the order but does not prevent us from correcting an obvious technical error, rejecting a fraudulent transaction or cancelling an order that cannot lawfully be fulfilled.

When an accepted order cannot be fulfilled, the affected amount will be refunded to the original payment method.

Prices and Payments

The price shown during checkout is the price applicable to the order, subject to correction of an obvious and recognizable technical error.

The payment methods currently supported by the store are American Express, Apple Pay, Bancontact, Diners Club, Discover, Google Pay, Mastercard, PayPal, Shop Pay and Visa. The methods actually available for an individual order are shown at checkout.

Delivery

Orders are fulfilled from the Netherlands.

Processing normally takes 1–2 business days. Orders placed after 14:00 Netherlands time begin processing on the next business day. Orders are not processed on weekends or Dutch public holidays.

Estimated transit times are:

Netherlands: 1–2 business days.
Germany, Belgium and Luxembourg: 3–5 business days.
France, Denmark and Austria: 5–8 business days.

Transit estimates are additional to processing time. Standard delivery is free. HEARTH & HUE LLC bears all standard delivery shipping costs.

Cancellations, Withdrawal and Returns

Cancellation may be requested before dispatch.

The store provides a 30-day commercial return period. EU consumers also have a statutory 14-day right of withdrawal for eligible distance purchases.

Authorized returns receive a prepaid label. HEARTH & HUE LLC bears all authorized return shipping costs.

Legal Conformity Guarantee

Goods supplied to EU consumers are covered by the mandatory legal conformity guarantee, including the minimum protection required by applicable national and EU law.

If goods are defective, not as described or otherwise non-conforming, the customer may be entitled to repair, replacement, price reduction or refund in accordance with applicable law.

Any commercial return policy is additional to these legal rights.

Intellectual Property

The website’s original branding, text, graphics, product imagery, layout and design elements are owned by or lawfully used by HEARTH & HUE LLC.

You may view and use the website for personal shopping purposes. You may not reproduce, distribute, sell or commercially exploit protected content without prior permission or another lawful basis.

Third-Party Services

The website uses third-party services, including Shopify and payment services selected at checkout. Those services may have their own applicable terms and privacy notices.

Links to third-party sites are provided for convenience. Their content and operation are controlled by their respective operators.

Availability and Website Changes

We may make reasonable changes to products, website features or these Terms. Changes do not retrospectively remove rights already acquired under an accepted order.

We may temporarily restrict access where reasonably necessary for maintenance, security or legal compliance.

Liability and Mandatory Rights

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including mandatory liability for fraud, intentional misconduct, death or personal injury caused by negligence, or mandatory consumer rights.

For matters that may lawfully be limited, liability is assessed under the applicable law and the circumstances of the claim.

Governing Rules and Consumer Protection

These Terms are governed by applicable law.

If you are an EU consumer, you continue to benefit from mandatory consumer-protection provisions of the country in which you habitually reside. Nothing in these Terms deprives you of those protections or of access to a court or dispute procedure available under mandatory law.
